Terms of Service

1. Agreement to Terms
By accessing and using CapeDrive Car Rentals ("we," "us," or "our") services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Rental Eligibility
To rent a vehicle from CapeDrive, you must:
- Be at least 21 years of age
- Hold a valid South African driver's license or international driving permit
- Have held a valid license for at least 2 years
- Provide valid identification (ID card or passport)
- Provide proof of address
- Have a valid credit or debit card for the security deposit
3. Booking and Payment
3.1 Reservations
All bookings are subject to vehicle availability. We reserve the right to refuse or cancel any reservation at our discretion. A booking confirmation will be sent via email or SMS once your reservation is confirmed.
3.2 Payment
Payment for the rental period must be made in full at the time of vehicle collection, unless prior arrangements have been made. We accept cash, credit cards, debit cards, and bank transfers (EFT).
3.3 Security Deposit
A refundable security deposit is required at the time of vehicle collection. The deposit amount varies depending on the vehicle type. The deposit will be refunded within 7-14 business days after the vehicle is returned in satisfactory condition, minus any applicable charges.
4. Rental Period and Extensions
The rental period begins at the time specified in your rental agreement and ends when the vehicle is returned to our designated location. If you wish to extend your rental period, you must contact us at least 24 hours before the scheduled return time. Extensions are subject to vehicle availability and additional charges.
5. Vehicle Use and Restrictions
5.1 Permitted Use
The vehicle may only be used for personal or business purposes within South Africa, unless prior written authorization is obtained.
5.2 Prohibited Uses
The following uses are strictly prohibited:
- Driving under the influence of alcohol or drugs
- Using the vehicle for illegal purposes
- Racing or participating in competitive events
- Transporting passengers for hire or reward
- Driving on unpaved roads or off-road without authorization
- Subletting or transferring the vehicle to another person
- Carrying more passengers than the vehicle's capacity
- Transporting flammable, explosive, or hazardous materials
6. Insurance and Liability
6.1 Insurance Coverage
All rentals include comprehensive insurance coverage as specified in your rental agreement. The insurance covers damage to the vehicle and third-party liability, subject to the excess amount specified in your agreement.
6.2 Excess and Deductibles
In the event of damage or loss, you will be responsible for the excess amount as stated in your rental agreement. This excess may be reduced by purchasing additional insurance coverage at the time of rental.
6.3 Exclusions
Insurance coverage does not apply to:
- Damage caused by driving under the influence
- Damage from racing or competitive events
- Damage to tires, windscreens, or interior (unless additional coverage is purchased)
- Loss or damage to personal belongings
- Consequential or indirect losses
7. Fuel Policy
Vehicles are provided with a full tank of fuel and must be returned with a full tank. If the vehicle is not returned with a full tank, you will be charged for the fuel required to fill the tank, plus a refueling service fee.
8. Mileage
Daily rentals include 100km free mileage per day. Additional kilometers will be charged at the rate specified in your rental agreement. Monthly rentals may include unlimited mileage - please confirm at the time of booking.
9. Vehicle Return
9.1 Return Location
Vehicles must be returned to the location specified in your rental agreement at the agreed time. Late returns may incur additional charges.
9.2 Condition
The vehicle must be returned in the same condition as when it was collected, except for normal wear and tear. You are responsible for any damage, loss, or theft that occurs during the rental period.
10. Breakdowns and Roadside Assistance
We provide 24/7 roadside assistance for all rentals. In the event of a breakdown or accident, please contact us immediately. Do not authorize repairs without our prior written consent, except in emergency situations.
11. Cancellations and Refunds
11.1 Cancellation by Customer
Cancellations made more than 48 hours before the scheduled collection time will receive a full refund. Cancellations made within 48 hours may be subject to a cancellation fee.
11.2 Cancellation by CapeDrive
We reserve the right to cancel a reservation if the vehicle becomes unavailable or if you fail to meet our rental requirements. In such cases, a full refund will be provided.
12. Limitation of Liability
To the maximum extent permitted by law, CapeDrive shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our vehicles or services. Our total liability shall not exceed the rental charges paid by you.
13. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
15. Governing Law
These Terms of Service are governed by the laws of South Africa. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of South Africa.
